01Acceptance of these terms
By creating an account or using LunAir, you agree to these Terms of Service. If you don’t agree, please don’t use the service.
These Terms form a legally binding agreement between you and LunAir.
02Who we are
LunAir is operated by Noe Marty, an individual sole proprietor (Einzelperson) based in Meilen, Zürich, Switzerland. References to “LunAir,” “we,” “us,” or “our” refer to Noe Marty.
03The service
LunAir is a web application that:
- Monitors live aircraft positions from the OpenSky Network
- Predicts when aircraft will pass close to the moon as seen from a geographic location you specify
- Sends alerts (in-app, and via push notification for paid users)
- Provides photography guidance and related features
The service is provided “as is.” We don’t guarantee it will be available 100% of the time, fully accurate, or suitable for any specific purpose.
04Your account
To use most features, you need an account. By creating one, you agree to:
- Provide accurate information
- Keep your password secure (authentication is managed by Clerk; we never see your password)
- Notify us promptly of any unauthorized access
- Be at least 16 years old, or have parental consent in your jurisdiction
- Use one account per person — no shared accounts, no automated bots
05Subscriptions and pricing
Free tier
- No charge
- Limited to one saved location and in-app notifications
Pro tier
- US$5 per month, or US$50 per year
- 14-day free trial when you sign up for the first time
- Auto-renewal at the end of each billing period
- Includes push notifications, multiple saved locations, and detailed shot setup data
Currency and taxes
Prices are listed in US dollars. Lemon Squeezy, our payment processor, acts as the merchant of record and may charge you in your local currency at the prevailing exchange rate. Lemon Squeezy includes applicable taxes (VAT, GST, sales tax) where required.
Price changes
We may change prices from time to time. We’ll give you at least 30 days’ notice before any change applies to your subscription. If you don’t agree with the new price, you can cancel before it takes effect.
06Free trial
The 14-day free trial begins when you start your Pro subscription. You must provide a valid payment method to begin the trial.
- If you don’t cancel before the trial ends, you’ll be charged for the first billing period
- If you cancel during the trial, you won’t be charged
- The free trial is offered once per customer
07Cancellation and refunds
Cancellation
You can cancel your subscription anytime from the customer portal (linked in your account). After cancellation:
- You keep Pro access until the end of your current billing period
- You won’t be charged again
- You can resubscribe anytime
14-day money-back guarantee
If you’re not satisfied with your first paid Pro subscription, email hello@lunairapp.com within 14 days of your first paid charge and we’ll refund you in full, no questions asked.
After 14 days, refunds are at our discretion. For annual subscribers, prorated refunds may be available within the first 30 days.
08Acceptable use
You agree not to:
- Use LunAir for any illegal purpose
- Reverse engineer, scrape, or attempt to bypass technical limitations of the service
- Interfere with the service or with other users
- Resell or commercially redistribute access to your account
- Use LunAir in any way that could compromise aviation safety or violate aviation regulations
- Create multiple accounts to evade limits or bans
- Use automated tools (bots, scripts) to interact with the service, except as we explicitly document
We may suspend or terminate accounts that violate these rules.
09Intellectual property
- LunAir — including the app, website, source code, content, design, name, and logo — is owned by Noe Marty and protected by copyright and other intellectual property laws.
- Flight data is provided by OpenSky Network under their separate terms of use.
- You retain full ownership of any photographs you take using LunAir. The app is just a tool; the work is yours.
- By using LunAir, you grant us a limited license to use anonymized, aggregated usage data to improve the service.
10Data and privacy
Our handling of your personal data is governed by our Privacy Policy. By using LunAir you agree to that policy as well as these Terms.
11Service availability and accuracy
Best effort, not guaranteed
We work hard to keep LunAir running and the predictions accurate. But:
- Aircraft data may be delayed, incomplete, or incorrect — it comes from third-party sources (primarily OpenSky)
- Transit predictions involve real-world uncertainty in aircraft tracking and atmospheric conditions
- The service may be temporarily unavailable for maintenance, updates, or events outside our control
- We don’t guarantee any specific level of accuracy or uptime
Photography is at your own risk
You’re responsible for your own safety when going outside to photograph transits. LunAir is not responsible for:
- Failed photo attempts or transits that didn’t happen as predicted
- Time spent waiting for transits
- Equipment damage, loss, or theft
- Injury or accidents
12Limitation of liability
To the maximum extent permitted by Swiss law:
- LunAir is provided “as is” without warranties of any kind, express or implied
- We’re not liable for indirect, incidental, consequential, or special damages
- Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose
- These limits don’t apply in cases of gross negligence or intentional misconduct
If you’re a consumer in a jurisdiction with non-waivable consumer protection rights (such as the EU), those rights apply regardless of anything in these Terms.
13Termination
By you
You can cancel anytime by deleting your account or canceling your subscription from the customer portal.
By us
We may suspend or terminate your account if:
- You materially violate these Terms
- You haven’t logged in for 24 months (free accounts only)
- Required by law
- We discontinue the service (with reasonable advance notice)
If we terminate your account without cause and you’ve paid in advance, we’ll refund any unused portion of your subscription.
14Changes to these terms
We may update these Terms from time to time. Material changes will be announced via email (to active accounts) and a notice on this page. Continued use after changes take effect constitutes acceptance. If you don’t agree with the updated Terms, please cancel before they take effect.
15Governing law and disputes
These Terms are governed by Swiss law, without regard to conflict-of-law principles.
Any dispute will be resolved by the competent courts in Zürich, Switzerland.
Consumers in the EU or EEA may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16Miscellaneous
- If any provision of these Terms is unenforceable, the rest remains in effect
- These Terms are the entire agreement between you and LunAir regarding the service
- We may transfer our rights and obligations under these Terms (for example, if we incorporate as a Swiss company)
- You can’t transfer your rights without our consent
- Failure to enforce a term doesn’t waive our right to enforce it later
- These Terms are written in English. Translations are for convenience; the English version controls in case of inconsistency
